Reader Makes New Claim Against Boca Raton Realtor John Rashotsky

BOCA RATON, FL (BocaNewsNow.com) — BocaNewsNow.com first reported yesterday that Boca Raton Police are investigating the apparent theft of escrow money paid to Boca Realtor John Rashotsky of Mizner Grande Realty. Here was part of our original post:

“A New Jersey doctor and his wife may have lost $67,500 in a possible scam involving escrow accounts in Boca. According to police, the couple placed the money in an escrow account at the direction of their Realtor, Jon Rashotsky, as they prepared to purchase a property. Incredibly, however, there was no contract for the property and the potential buyers are now unable to get their money back.”

We have now received word from a reader that the apparent victims are not alone. Here is part of the note we received: “I too was scammed by Mizner Grande Realty and Jon Rashotsky, as well as Edgar A. Benes, PA of my $2700. escrow amount. I live on a fixed income, and that money was absolutely necessary to completing the sale of a condo to me sometime this week. The Benes law office has refused to cooperate in setting a date for release of my funds.”

I am attaching a letter I received yesterday from an attorney, purportedly explaining the problems. I have enquired as to whom he represents, but to date have not received a response. If you know of a specific police official who is handling this case, please let me know, so that I may file formal charges.”

    Good morning to all!

    I would like to take a second and clarify the involvement of Mizner Grande Realty, John Rashotsky was an independently contracted ROGUE agent. Mizner Grande has had nothing to do with any unlawful escrow disbursments or any unlawful allegations, period.

    Ari Albiner, Mizner Grande Realty’s head honcho, and employing broker has been operating and executing clean, concise real estate transactions in Boca Raton for almost 20 years. Ari’s presence in the Boca Raton market is tremendous. His track record over the past couple decades has proven Ari to be a powerhouse broker in this city. I trust Ari as my broker, as should you.

      We received the following email from a reader. We publish it like other comments, but the comments have not been verified by BocaNewsNow.com:

      I called Ari to warn him of Rashotsky. I told him that he was known by many agents and clients in Delray Beach as a thief. I personally had a horrible situation with him involving underhanded tactics. Two of my friends almost lost 15k of rental deposits on listings he didn’t even have listed. The money was returned a few weeks after threatening Jon with legal action.
      I have known of Ari for many years as a respectable business man, but he should have checked out my warnings. If he did and still elected to associate himself with this thief than he deserves all of the bad press he has and will be getting. The old adage if you hang around with bank robbers, you will be presumed to be one as well.
      Everything else you hear may be rumors or exaggerations but these items are all fact.

    Jon Rashotsky was fired from Mizner Grande Realty. He is no longer associated with Mizner Grande Realty.
    MGR has taken every necessary measure to cooperate and inform Delray Police Department as well as the FREC, Florida’s Real Estate Commission of any unlawful activity cohered by Mr. Jon Rashotsky.
    Any disbursements from escrow accounts were done at Jon Rashotsky’s request and were completely unknown and unauthorized by Mizner Grande Realty.

    I would like you to put me in contact with the detectives or attorneys regarding this case. I had the same problem with Jon Rashotsky and Ari Albinder of Mizner Grande Realty back in May of 2011.
    I gave Jon Rashotsky a deposit of $5,100.00 and after some due diligence I found out the square footage of the unit was incorrect on his listing. I told Jon that I wanted another unit with the correct square footage.
    It was a long ordeal of threats and lies from Jon as he refused to give my deposit back. I called Mizner Grande Realty and left several phone and email messages for Ari with no response. When I did finally catch Ari on the phone I asked him if he had received my messages and he replied, and I quote, “yes, you shouldn’t have changed your mind” and promptly hung up the phone on me.
    After filing complaints with the FREC, DPBR, BBB, sending certified letters to Jon and Ari and even contacting Channel 5 News to where they were going to broadcast the complaint on the 11:00 news that evening, I finally got my deposit back.
    I hold Ari Albinder equally responsible because I believe he was well aware of what was going on!
