BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2024 MetroDesk Media, LLC) — The Boca Golf and Tennis Property Owners Association is suing a homeowner who the Board claims is annoying and preventing the community from conducting day-to-day business. The homeowner, identified as Annie Cummins, allegedly violated the rules and regulations of the community when she interrupted meetings, impersonated the Board, and apparently demanded that the City of Boca Raton build a tunnel for golf carts.

“Defendant has violated the Declaration and thereby, Florida Statute §720 by demonstrating behavior and taking actions that are improper, inappropriate and disruptive, and which constitute a nuisance. More specifically, there have been several different incidents over the past several months including, but not limited to, the following: Impersonating a Board member to Paving Lady, for a quote for sealcoating the main road of the community. Being incessantly disruptive at Board meetings. Not following and adhering to the three (3) minute limitation on speaking on agenda items. Incessantly harassing Board members at the Board meetings.

Engaging, harassing and directing Association vendors working in the community. Following the Board president around asking questions and demanding answers while on a walk through inspecting a tree which was reported by two homeowners in Somerset as a hazard. Incessantly asking the Board members questions on matters you are aware the Board has considered closed. Accusing the Board president of not demanding the City to open their own entrance because there is an alleged ulterior motive by the Board president to have the north gate opened so an ornate guardhouse can be built to house an office for her “Grandson Joey Kandil.”

The Board also accuses Cummins of behavior that it says is unacceptable at meetings and in the community, while making unrealistic demands.

“Constantly belittling management personnel via email communications and in person at Board meetings, and on other occasions. Calling the City representatives and architects on numerous occasions and making various unreasonable and/or unnecessary demands. k. Continuing to demand the Board request the City to build a tunnel so the golf carts do not use the roads.“

“Requesting the Board install a toll for anyone entering the community for the golf course. Recording Board meetings without giving prior notice as required by the adopted rules. Not allowing the Board to conduct business which has resulted in the Board having to abruptly adjourn not less than three (3) meetings to date. Requesting mailings to the members but not understanding the Board members for the Master Association are the members. Constantly accusing management and the Board members of not sending the appropriate notices for scheduled meetings. Claiming management fails to forward information. Threatening the property managers in connection with their professional licenses. Requiring the Association to incur additional expenses for attorney fees and for a police officer to attend Board meetings due to your improper behavior. Sending multiple harassing emails to the Board members with demands, objections and accusations. Interrogating and disrupting Board members while walking the community to ask questions, make demands, interrogate and disrupt their personal space and time. Requesting rent for the community office where Association staff work. Creating a nuisance in and around the community and in Board meetings that prevents the Board from operating and effectively performing its business.”

Ms. Cummins had not filed a response to the suit that had been processed by the Palm Beach County Clerk of Courts as of 8 a.m. Friday. The suit seeks an injunction against Cummins.

  1. A shame some folks just do such crazy things, because they can. It must be exhausting dealing with this individual and such that a legal document was drawn up to deal with her crazy actions. Maybe it’s time for some medical intervention here for someone who seems to be mentally unhinged. Seems like the time has come for some action to control this person and I wish the board luck in any future dealings.

  2. I don’t see any violations here. To determine such behaviors as violations and disruptions, more details needed. She is a resident and has a right to ask and demand if ignored. I am interested in following this suit and see where it goes. Poor HOAs are having so much pressure now that the control of their actions is tightened by the state. So not used to it.

    1. I live in this community- have attended many meetings – can assure people that she is HIGHLY disruptive- as a matter of fact, meeting this morning had a police officer attend to keep her quiet! Lucky for us all, she didn’t show up so a good meeting was held.

  3. You just automatically believe what they say about her. There are two sides to every story. I too, don’t see where she was given notices or violations. I’m in a co op. Here, they pull your proprietary lease and you’re evicted. I personally experienced you can’t fight city hall. Also do they have proof or witnesses to these allegations. I feel sorry for her.
