BOCA RATON, FL (BocaNewsNow.com) — A lawsuit just filed in Palm Beach County Circuit Court alleges that the Boca Falls Homeowners Association had a responsibility to block off an area of a sidewalk outside a home to prevent a neighboring homeowner from slipping on something “slippery.”
Bonnie Fenyves was allegedly walking in the common area between “12217 Rockledge Circle and 12223 Rockledge Circle” on January 14th, 2020 when she fell.
“At that time and place, while walking in the common area described above, Plaintiff slipped and fell on algae or some other slippery substance and sustained serious and permanent injuries… Defendant had a duty to take such precaution as were reasonable and necessary to protect its invitees, including Plaintiff, from slipping hazards on the sidewalks of the common areas.”
Claims the suit: “As a result, (Fenyves) suffered bodily injury and resulting pain and suffering, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, expense of hospitalization, medical and nursing care and treatment and aggravation of a previously existing condition. The losses are either permanent or continuing and Plaintiff will suffer the loses into the future.”
The filing also states that Fenyves and her husband, Steven Fenyves, suffered and will continue to suffer, “loss of society, loss of services and loss of consortium.” The Fenyves’ own the home at 12246 Rockledge Circle — just 348 foot steps away, according to Google maps.
The Fenyves, through attorney Daniel Haverman, are seeking a jury trial for damages in excess of the statutory minimum of $30,000.
Boca Falls is a large, upscale community in West Boca Raton. It is positioned between Glades Road and Palmetto Park Road, far west of U.S. 441.
