Malpractice Claim Filed Against Dentist With Perfect Record, According To State Of Florida.

PALM BEACH COUNTY, FL (BocaNewsNow.com) (Copyright © 2021 MetroDesk Media, LLC) — A Palm Beach County Dentist is facing a medical malpractice suit for allegedly pulling the wrong teeth from a child.

Peter M. Habashy’s dental practice is named as the defendant. The specific dentist allegedly responsible for the claimed malpractice is not named.

According to the suit just filed in Palm Beach County Circuit Court:

“Defendant, PETER M. HABASHY DDS, at all times material hereto, had a duty to provide dental care in his care and treatment to minor Plaintiff, [redacted], in a manner commensurate with the applicable and recognized standard of care for a similarly situated healthcare provider. Notwithstanding said duty, Defendant, PETER M. HABASHY, D.D.S., deviated from the applicable and recognized standard of care, and was otherwise negligent, one or more on the following ways: By failing to obtain appropriate informed consent; b) By failing to provide a comprehensive dental treatment plan; c) By extracting primary tooth letter K instead of primary tooth letter M; d) By extracting primary tooth letter T instead of primary tooth letter R.”

As a result of the alleged malpractice, the suit claims the following:

”The minor Plaintiff was injured in and about her body and extremities, suffered pain, disability, disfigurement, mental anguish, loss of the capacity of enjoyment of incurred medical expenses for the treatment of said injuries, suffered physical dicap and aggravated a pre-existing physical condition. Said injuries are either ermanent or continuing in nature and the Plaintiff will suffer such losses and impairments in the future.”

BocaNewsNow.com has redacted the name of the child.

The lawsuit, filed by Attorney Lisa Levine, seeks in excess of $30,000, the statutory minimum for filing in Palm Beach County Circuit Court.

There was no immediate response to the suit filed by Peter Habashy or his dental practice. Habashy Dental is located in Palm Beach Gardens. Dr. Habashy’s medical license, according to the State of Florida, is completely clear of complaints and discipline. There is no record of a previous issue.

Lawsuits are allegations that will be presented, and disputed, in a court of law.
