Three Inspections, Ten Violations In Just Days For “Bagels With Deli.”

A Delray Beach Deli required three inspections over just a few days after an inspector with the Florida Department of Business and Professional Regulation didn’t like what was seen during a routine check-up on October 31st. “Bagels With” Deli at 1732 South Federal Highway in Delray was not ordered to close.

Per BocaNewsNow.com policy, we are publishing the unedited observations documented by the State of Florida. This is what was noted during the first inspection on October 31st when four “high priority” warnings were issued.

High Priority – Time/temperature control for safety food cold held at greater than 41 degrees Fahrenheit. 1)Observe at display refrigerator flip top ; chicken (56F – Cold Holding) due to over filled. 2) Observe at Flip top refrigerator ; chicken salad,tuna salad,sliced tomato,,sliced cheese,macaroni salad (44-50F – Cold Holding). 3). Observe at Cream cheese flip top refrigerator ; sliced cheese, pooled eggs,ham, cream cheese (44-60F – Cold Holding). Operator removed the overfilled food. **Warning**

High Priority – Stop Sale issued on time/temperature control for safety food due to temperature abuse. Observe at walk-in refrigerator chicken soup overnight (50-51F – Cooling) **Warning**

High Priority – Raw animal food stored over/not properly separated from ready-to-eat food. Observe raw fish above cooked sausage. Operator placed raw fish on lower shelf.. **Corrected On-Site** **Repeat Violation** **Warning**

High Priority – Cooked/heated time/temperature control for safety food not cooled from 135 degrees Fahrenheit to 41 degrees Fahrenheit within 6 hours. Observe at walk-in refrigerator chicken soup overnight (50-51F – Cooling). See stop sale **Warning**

Basic – In-use utensil stored in standing water less than 135 degrees Fahrenheit. Observe utensils in standing water at 72°F . Operator removed water. **Corrected On-Site** **Warning**

An inspector returned on November 1st and documented this:

Basic – – From initial inspection : Basic – In-use utensil stored in standing water less than 135 degrees Fahrenheit. Observe utensils in standing water at 72F . Operator removed water. **Corrected On-Site** **Warning** – From follow-up inspection 2022-11-01: **Time Extended**

An inspector returned again on November 7th and documented two “high priority violations,” one “intermediate violation,” and two “basic violations.”

High Priority – Time/temperature control for safety food, other than whole meat roast, hot held at less than 135 degrees Fahrenheit. At steam table; chicken soup (119°F – Hot Holding). Operator stated item reheated on stove 2 hours prior. Moved item back to stove to reheat. **Corrective Action Taken**

High Priority – Raw animal food stored over/not properly separated from ready-to-eat food. At front counter low boy reach in; raw shell eggs stored over ready-to-eat bacon. Operator moved eggs below bacon. **Corrected On-Site** **Repeat Violation**

Intermediate – Raw/undercooked animal food offered and establishment has no written consumer advisory. Raw animal foods must be fully cooked prior to service. Provided consumer advisory. Operator posted. **Corrected On-Site**

Basic – Cloth used as a food-contact surface. At walk-in cooler; cloth used to cover roast beef. Operator removed cloth. **Corrected On-Site**

Basic – Bowl or other container with no handle used to dispense food. At bagel area storage bins; 1/6 pan used to dispense food. Operator removed 1/6 pan. **Corrected On-Site**

Despite the violations on November 7th, the Florida Department of Business and Professional Regulation noted that “Bagels With” met inspection standards during the visit.
