BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2023 MetroDesk Media, LLC) — A parent is suing Boomer’s Boca Raton for more than $50,000 after she says her kid drove a Go-Kart into a wall. There’s no mention of the waivers parents sign before kids are allowed do pretty much anything at the entertainment complex in East Boca Raton.
According to the complaint just filed in Palm Beach County Circuit Court, an employee identified as a manager or “agent” of APX! Boomers, the company that owns Boomers, is accused of not doing his job correctly. That alleged negligence, according to the suit, led to the child driving her Go-Kart into a wall.
From the suit: “On or about January 7, 2022, KB was operating a go-kart at the Defendant’s facility when it was caused to go out of control and hit a wall. At all times material hereto, the Defendant, APX Boomers! Boca Raton LLC, had a duty to ensure that its operators were capable of operating its Go-Karts and to sneer that others were operating the Go-Karts in a non-negligent manner. At all times material hereto, Defendant, Andrew Mariciante, was an employee, agent, and /or servant of the Defendant, who participated in the activities of the care and maintenance of the facility, and whose duties included supervising, overseeing, training, warning, and overseeing all aspects of the facility including the Go-Karts.”
The suit claims that KB was injured “in and about her body, suffered aggravation of pre-existing conditions, pain and suffering, disability, disfigurement, impairment of working ability, mental anguish, loss of enjoyment of life,” and more.
KB’s mother is represented by Lance Ivey of Lytal, Reiter, Smith, Ivey and Fronrath. Boomers had not filed a response as of late Tuesday afternoon. Read the complete suit, below.
