Uber is being sued by a Palm Beach County woman who claims an Uber driver crashed into her car in Delray Beach.

DELRAY BEACH, FL (BocaNewsNow.com) (Copyright © 2023 MetroDesk Media, LLC) — A crash in Delray Beach was allegedly caused by an UBER driver, and now the victim is suing UBER for at least $50,000. The suit was just filed in Palm Beach County Circuit Court.

According to the complaint reviewed by BocaNewsNow.com, the crash happened earlier this year on Atlantic Avenue. The following is the actual language used by the Plaintiff’s attorney in the official complaint:

“On or about January 10, 2023, Plaintiff, EMILY MAAS, was traveling westbound on Atlantic Avenue, approaching the intersection of E. Atlantic Avenue and Palm Square in Delay Beach, Palm Beach County, Florida. At that time and place, Defendant, CLIFFORD ALFRED, was driving the aforementioned Honda, exiting a parking lot at Palm Square onto Atlantic Avenue.

At that time and place, the Defendant, CLIFFORD ALFRED, negligently operated his motor vehicle so as to cause it to collide with the Plaintiff’s motor vehicle. Upon information and belief, at the time of this accident Defendant, CLIFFORD ALFRED was logged on to the Uber App and was appearing as a Uber and/or Uber X driver available for providing transportation services to users and/or was viewing, monitoring and/or interacting with his wireless communication device/smartphone/GPS/ at or near the time of collision, and/or was traveling to a potential customer that had requested his services using the Uber App.”

The complaint also claims that the Plaintiff, Emily Maas, was critically injured.

“As a direct and proximate result of the aforementioned negligence, Plaintiff EMILY MAAS, suffered bodily injury and resulting pain and suffering, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, expense of hospitalization, medical and nursing care and treatment, loss of earnings, loss of ability to earn. The losses are either permanent or continuing and Plaintiff EMILY MAAS will suffer the losses in the future.”

Attorneys for UBER had not filed a response to the suit as of mid-day Friday, March 31st, 2023.
