SECOND SUIT IN DAYS. THIS TIME, NEGLIGENCE, PHYSICAL, MENTAL ABUSE.

BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2023 MetroDesk Media, LLC) — For the second time in two days, a lawsuit filed against Encore at Boca Raton Rehabilitation and Nursing Center reveals allegations of negligence, physical, and mental abuse. The latest suit, just filed in Palm Beach County Circuit Court, is on behalf of a woman who died in April of 2022.
According to the suit: “Defendant has a statutorily mandated responsibility to KATHLEEN M. BAFFI to provide her with her nursing home resident’s rights, as set forth in Florida Statute $400.022, which responsibility included, but was not limited to, the following: providing adequate and appropriate healthcare and protective and support services; preventing mental and physical abuse of KATHLEEN M. BAFFI complying with regulations for the operation of nursing homes promulgated by the Department of Health and Rehabilitative Services and contained in the Florida Administrative Code 59A-4; and treating residents courteously, fairly, and with the fullest measure of dignity.”
The suit accuses the staff at Encore Boca Raton of: “failing to appropriately monitor KATHLEEN M. BAFFI and recognize significant signs and symptoms of change in her health condition, such as suffering the development and deterioration of respiratory failure; failing to properly notify the family and physicians of KATHLEEN M. BAFFI of significant changes in her health status, such as suffering the development and deterioration of respiratory failure; failing to protect KATHLEEN M. BAFFI from foreseeable harm, including but not limited to suffering the development and deterioration of of respiratory failure; failing to properly supervise staff; failing to properly train staff; improper retention of staff; Inadequate staffing; failing to protect the dignity of KATHLEEN M. BAFFI; failing to protect the privacy of KATHLEEN M. BAFFI; failing to follow physician orders; failing to properly chart on the resident pursuant to Florida Statute § 400, F. A. C. 59-A; and 42 C. F. R. 483; and, failure to timely transfer the resident to the hospital.”
Baffi died in April of 2022. The suit seeks in excess of $30,000, the statutory minimum for filing in circuit court in Palm Beach County. The suit follows a complaint just filed against Encore in another matter, and several suits filed over the past several years. Baffi’s family is represented by William Dean, Esq., of Ford, Dean, and Rotundo of North Miami Beach.
