BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2023 MetroDesk Media, LLC) — Mega community Boca West Country Club wants its money, and now it is suing a homeowner who Boca West says hasn’t paid $199,999.97 in fees and dues.
According to a complaint reviewed by BocaNewsNow.com, Andrew Bizaev has not paid money due since 2018. From the complaint: “This is an action for Breach of a Third Party Beneficiary Contract and a recorded Declaration resulting in damages to Plaintiff for past due application fees, equity payments, capital improvement payments, and annual membership dues for 2018/2019, 2019/2020, 2020/2021, 2021/2022 and 2022/2023 which are owed pursuant to the Master Declaration of the Boca West Master Association, Inc. and the CLUB’s Bylaws for an amount greater than One Hundred Thousand Dollars ($100,000.00), exclusive of interest, costs and attorneys’ fees, and is otherwise within the jurisdiction of this Court.”
Also from the complaint: “Defendant materially breached his obligations pursuant to the Declaration by failing to comply with Plaintiff’s governing documents. Specifically, Defendant failed to pay his application fee, failed to pay his equity payment, failed to pay his capital improvement payment, failed to pay the prior Member’s annual membership dues for 2018/2019, 2019/2020, 2020/2021 and 2021/2022, and Defendant’s Membership dues for 2022/2023, all of which are and remain due and owing to Plaintiff for the LAKESIDE real property.”
Read the complete lawsuit here. Public records indicate that Bizaev owns two properties in Boca West: the 7835 Lakeside Boulevard property, and and an additional unit on Boca West Drive. No response to the suit had been processed by the Palm Beach County Clerk of Court as of early Tuesday morning, June 27th, 2023.
