BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2023 MetroDesk Media, LLC) — The latest homeowner to learn that association fees are not optional in Florida is a homeowner in Boca Woods. According to a complaint filed in Palm Beach County Circuit Court and obtained by BocaNewsNow.com, Rita Kroll of the 11400 block of Boca Woods Lane hasn’t paid association and related fees since October, 2020. Boca Woods is now seeking a lien of foreclosure on her property.
The complaint reveals that with dues and fees, Kroll allegedly owes $12,663.84. It’s unclear why she hasn’t paid since October of 2020, or why Boca Woods let the count remain in arrears for so long. The assessments are listed as $1107 or $1160 monthly. Interest and attorney fees were also applied.
Kroll purchased the 3503 square foot home in July of 2004 for $315,000. The home carries a double homestead exemption, according to the Palm Beach County Clerk of Courts.
Homeowner association fees and dues are not optional in Florida. When you live in an HOA, COA, or similar association, you are responsible for any and all assessments levied by the association — although a homeowner does have the right to challenge fees and fines in court.
