Palm Beach County Sport Court Construction And Surfacing Company Facing Lawsuit.

DELRAY BEACH, FL (BocaNewsNow.com) (Copyright © 2024 MetroDesk Media, LLC) — The Delray Beach gated community of Casabella is suing a Palm Beach County sport court installation company which allegedly took the community’s money but didn’t provide the expected services. Sport Surfaces of 7011 Wilson Road in West Palm Beach is the defendant.
According to the suit filed in Palm Beach County Court and obtained by BocaNewsNow.com, the Casabella Property Owners Association entered into an agreement in December of 2022 to construct a tennis court and to resurface a basketball court. The total price: $141,440. Sport Surface required a down payment of $35,360 which Casabella paid.
But nearly a year and a half later, construction has not begun. The problem: according to the suit, Sport Surfaces has yet to obtain a permit from Palm Beach County to perform the work. There is no indication that a permit request was made.
The suit alleges breach of contract that has led Casabella to suffer damages — it seeks between $30,000 and $50,000 in Palm Beach County Civil Court. Sport Surfaces appears to be a business that remains operational. On May 10, 2024, Sport Surfaces attorneys, Frank DelloRusso, Esq. and Geoffrey Liter, Esq., of South Florida Law PLLC, have made an appearance in the Court and intend to defend the case on its merits.
