LAWSUIT: Boynton Woman Says AT&T Tech Drilled Into Her Sewer Line

BOYNTON BEACH, FL (BocaNewsNow.com) (Copyright © 2024 MetroDesk Media, LLC) — A Boynton Beach woman says a technician with AT&T drilled into a sewer line on her property, causing sewer backups onto her property and into her home. Mariana Catanzaro is now suing AT&T in Palm Beach County Circuit for in excess of the statutory minimum — $50,000.

According to the complaint obtained by BocaNewsNow.com, “On or about September 2020, Defendant drilled onto Plaintiff’s property and punctured several portions of her sewer line which resulted in sewer backups into her property. On April 17, 2023, after extensive due diligence, Plaintiff realized that Defendant was the cause of the issues she was experiencing in her home.

Plaintiff attempted to get Defendant to fix the issue and notified AT&T about the punctured sewer line. However, Defendant has not taken responsibility for the damages caused on her property despite being aware of the problem. The sewer line remains damaged and Plaintiff’s desires to have it properly fixed to avoid any future water backups into her home. At the time of filing of this complaint, Defendants have failed to take responsibility or the damages to Plaintiff’s property.”

The complaint also states: “At all times relevant, Defendant breached its non-delegable duty owed to Plaintiff by committing one or more of the following omissions or commissions: ( Negligently failing to properly perform directional drilling, thus creating a hazardous condition to Plaintiff as a result of the improper drilling; Negligently failing to inspect or adequately warn Plaintiff of the danger associated with the improper drilling, when Defendant, knew or through the exercise of reasonable care should have known that said drilling was unreasonably dangerous and that Plaintiff was unaware of same; Negligently failing to correct or adequately correct the improper drilling, when said condition was either known to Defendant or had existed for sufficient length of time such that Defendant should have known of same had Defendant exercised reasonable care.”

AT&T had not filed a response to the lawsuit as of Wednesday, June 26th, 2024. Ms. Catanzaro is represented by The Desir Law Firm, P.A., of Sunrise.
