BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2024 MetroDesk Media, LLC) — A woman claims she was critically injured after walking in the outside eating area of the Boca Raton Cheesecake Factory, got caught in a chair, and fell to the ground. Attorneys for Donna Kleiner-Lichtman just filed suit in Palm Beach County.
According to the complaint obtained by BocaNewsNow.com, Kleiner-Lichtman, who lives in Broward County, was eating at Cheesecake Factory at 5530 Glades Road in Boca Raton on (or about) February 11, 2023. That’s when, “at approximately 9:15 p.m., after finishing her meal, Plaintiff Donna Kleiner-Licthman got up to leave the restaurant. As she was leaving the restaurant, her foot became caught in a chair that was extending out into the walkway, causing (her) to violently trip and fall, causing her serious injury.”
The suit alleges that it was dark and the outside lighting of the restaurant was “of poor quality, causing a dangerous condition for its patrons.” The suit additionally alleges that the Cheesecake Factory failed to use appropriate lighting, failed to warn guests of dangers, failed to prevent hazards, and failed to maintain the common areas in a reasonably safe and proper condition.
Donna Kleiner-Lichtman, according to the suit, suffered serious injuries leading to pain, exacerbation of a pre-existing injury or physical condition, mental anguish, lost wages, and loss of ability to earn money in the future. She also, according to her attorneys, has suffered the “inability to lead a normal life.”
The suit seeks in excess of the statutory minimum in Palm Beach County Circuit Court which is $50,000. She is represented by Attorney Jeffrey M. Braxton of The South Florida Injury law Firm in Coral Springs.
