NURSING HOME NEGLIGENCE SUIT JUST FILED. READ THE COMPLAINT.

BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2025 MetroDesk Media, LLC) — Menorah House Assisted Living Facility at 9945 North Central Park Boulevard in Boca Raton is facing a major lawsuit from a one-time resident who claims that extreme negligence and apparent incompetence led to her serious injuries. Michelle Brotman seeks in excess of $100,000 in her lawsuit just filed against Terrace of Boca Raton which operates as Menorah House. The suit was filed in Palm Beach County Circuit Court. >> From November 4, 2022, through December 20, 2022, MICHELLE BROTMAN, was an adult resident of TERRACE OF BOCA RATON, LLC, d/b/a MENORAH HOUSE (hereinafter referred to as “MENORAH HOUSE”) At all times material hereto, MICHELLE BROTMAN, was an adult person who was suffering from infirmities, including as the result of lumbar spine surgery, to the extent that she was impaired and was unable to adequately provide for her own care and protection. During MICHELLE BROTMAN’s residency at MENORAH HOUSE, the staff and employees failed to develop an adequate care plan and properly monitor and supervise the care and treatment provided to MICHELLE BROTMAN in order to prevent her from suffering deterioration and injuries. As a direct result of MENORAH HOUSE’s acts and omissions, MICHELLE BROTMAN suffered injuries and deterioration to the site of her lumbar spinal surgery.
Failing to follow applicable policies and procedures governing the prevention of falls; Failing to properly monitor and observe a high fall risk resident; Failing to appropriately treat and evaluate a resident following a fall; Failing to supervise Michelle Brotman; Failing to prevent Michelle Brotman from falling; Failed to respond to Michelle Brotman’s multiple requests for help to go to the bathroom; Failing to put into place proper interventions to prevent Michelle Brotman from falling; Failing to uphold the rights of the resident under § 400.022, Florida Statutes; Failing to follow state regulations to protect residents; Failing to provide reasonable and appropriate care; Failing to exercise reasonable care under all the surrounding circumstances; and, Failing to place and or maintain a brace on Michelle Brotman; Failure to follow physician’s orders; Failure to provide adequate and appropriate protective and support services to MICHELLE BROTMAN Failure to develop, implement, and update an adequate and appropriate resident care plan to meet the custodial needs of MICHELLE BROTMAN; Failure to adequately monitor, document and advise of changes in her MICHELLE BROITMAN’S health condition.
As a direct and proximate result of the failure of the Defendant, MENORAH HOUSE, to comply with the requirements of Florida Statute 400.022, and to provide adequate and appropriate and protective support services, MICHELLE BROTMAN suffered damages, including loss of dignity; humiliation; bodily injury; pain-and-suffering; disability; physical impairment; disfigurement; mental anguish; inconvenience; loss of capacity to enjoy life; discomfort; aggravation of an existing disease or physical condition; medical, hospital and nursing expenses. <<
Menorah House had not responded to the suit as of 5 p.m. Monday, April 21, 2025. Brotman is represented by Attorney Milton Blaut of the Blaut Firm in Plantation.
