Major Lawsuit Filed In Palm Beach County Circuit Court.

PALM BEACH COUNTY, FL (BocaNewsNow.com) (Copyright © 2025 MetroDesk Media, LLC) — The parents of a student at The Weiss Gifted & Talented School in Palm Beach Gardens are suing the institution, claiming their child was seriously injured during a game of “Gaga Ball.” Leonardo Bean Gismano and Victoria Rosa Bustamante Iturrieta filed the complaint in Palm Beach County Circuit Court on behalf of their minor child, seeking damages in excess of $50,000 exclusive of costs and interest.
According to the lawsuit reviewed by BocaNewsNow.com, the incident occurred on or about December 16, 2021, while the student was on the school’s campus at 4176 Burns Road. The complaint alleges that while playing the game with other students, the child fell and fractured his left forearm. The filing contends that the school owed a duty of care to minimize foreseeable risks but failed to ensure the game environment was safe for students.
Attorneys for the family argue that the school knew or should have known about the allegedly unsafe condition of the Gaga Ball game and its setup yet failed to warn students or provide adequate supervision. The suit accuses the school of negligence for failing to conduct proper inspections, failing to maintain the equipment in a reasonably safe condition, and failing to train personnel on preventing such hazards. As a result, the plaintiffs claim the child suffered permanent injuries, disability, mental anguish, and incurred expenses for hospitalization and ongoing medical care.
The lawsuit claims that the Weiss School engaged in a negligent mode of operation regarding the supervision of its students, creating an unreasonable risk of harm. Represented by The Pendas Law Firm based in Coral Gables, the family is demanding a trial by jury. The Weiss Gifted & Talented School has not yet filed a response to the complaint.
