The suit, filed in Palm Beach County Circuit Court and obtained by BocaNewsNow.com, alleges that Superhero Kids PPEC, LLC, failed to provide necessary supervision and medical attention to the toddler during a July 2024 visit. The facility, which specializes in caring for children with complex medical conditions, is accused of negligence that led to the child’s death after she was reportedly left without sufficient oxygen for a prolonged period. SuperoKids is located at 1700 Woolbright Road.
The lawsuit details a harrowing series of events that began on the morning of July 1, 2024, when the child was picked up from her home by a bus operated by the facility. The toddler, who had been born premature and required a tracheostomy with supplemental oxygen due to a heart condition, was under the facility’s care for the day. According to the complaint, staff failed to monitor the girl’s deteriorating condition and did not call for emergency medical services or contact her family as her health declined. It was only when she was returned home at the end of the day that it became clear she had suffered from a lack of oxygen.
Attorneys for the family claim that Superhero Kids PPEC breached its duty of care by failing to implement a proper supervision plan and failing to recognize signs of medical distress. The complaint specifically points to a lack of adequate training for the staff responsible for monitoring the medically fragile child. As a Prescribed Pediatric Extended Care (PPEC) center, the facility is licensed by the state to handle children requiring continuous therapeutic intervention, making the alleged oversight a central focus of the negligence claim.
The suit seeks damages in excess of $50,000 for the child’s survivors, including her parents. That amount is the statutory minimum for filing in Palm Beach County Circuit Court. While the facility is licensed to operate as a specialized daycare, the lawsuit claims that it is vicariously liable for the actions or omissions of its employees that day.
