A man told police he was raped by his male roommate. But a police report suggests that’s not true, and now the alleged victim is being sued by his one-time friend for libel and slander.
According to a complaint just filed in Palm Beach County Circuit Court, obtained by BocaNewsNow.com and published below, Patrick O’Malley of Sharpsburg, GA, says Richard Drury Jr. of Amityville, New York fabricated a story that O’Malley raped him while the two were sharing a hotel room during an event at the resort in September.
According to court filings and police records, the incident began when Drury arrived at the Boca Raton Regional Hospital emergency room in the early hours of September 9, 2025, requesting a rape examination. Drury told investigators he woke up undressed in his hotel room and saw O’Malley attempting to pull his pants back up. However, police reports note that Drury also admitted he did not remember much of the night, felt no physical pain or sensations of penetration, and even stated his underwear had never actually been removed.
Detectives reviewed a video Drury recorded on his phone during the encounter. In the recording, O’Malley is reportedly heard telling a “drunk” Drury to go to bed while explaining that he was simply trying to help him get his clothes off and get settled on the couch. A “controlled call” monitored by police further supported O’Malley’s version of events, and a sexual assault nurse found no physical evidence of a battery. Investigators classified the matter as a “suspicious incident” and moved to inactivate the case pending DNA results.
O’Malley’s lawsuit alleges that Drury’s “false and erratic” accusations were made with “actual malice” to destroy his reputation within their close-knit professional community. The complaint states that the fallout has already cost O’Malley significant business opportunities, referrals, and professional standing. O’Malley is now suing Drury for at least $50,000, the statutory minimum for filing in Palm Beach County Circuit Court.
