Do The Messages Prove Lotus HOA Had Prior Knowledge Of Potential Problem?

The original charge — simple battery — has been removed. The new charges represent what police and the State Attorney’s office say are appropriate charges based on the video evidence of Schuman seemingly throwing a water bottle at a child bicyclist, then taking his cell phone.
Investigators are not saying, however, whether or not they are aware of a prior incident involving Schuman on the same street in the Lotus community with a child bicyclist back in December. According to a series of text messages obtained by BocaNewsNow.com sent through a Lotus community messaging platform, Schuman appears to describe an aggressive interaction with a child performing “wheelies” on a bike.
Many — but not all — of the people on the text chain from December 20, 2025 told Schuman that he was wrong to engage with a child and that he should leave the child alone. Community members also told Schuman back in December that he should not try to gain control of a child’s phone — something he wrote about in the texts. As evidenced by the new charges against Schuman, it is illegal in Florida to deprive someone of access to their communication device.
It is not believed that police were called following the incident in December — but the similarities are notable. Just like the December incident that he apparently texted about, Schuman accused the child victim on Friday of performing “wheelies” on “Paradise Bay Avenue,” the main road in the community of $1M+ homes. It’s unclear if the child involved in Friday’s incident is the same child involved in the December incident.
Attorneys tell BocaNewsNow.com that the text messages could be used to prove that the Lotus HOA had prior knowledge of a potential problem with a homeowner acting aggressively towards children, but did nothing to stop the behavior. The text messages, legal professionals say, could be a key element in potential civil litigation against the homeowners association.
We again publish the video of the two incidents involving Schuman, several other adults, and the child from last week. The first video appears to show Schuman throwing a water bottle at the child. The second video shows several adults — men and women — refusing to return the child’s cellphone while some engage in physical restraint of the boy.
Schuman on Tuesday retained both a local criminal defense attorney and a crisis communication firm which sent BocaNewsNow.com this statement: “We understand the public interest in this case, but we will not litigate it in the media. Mr. Schuman is entitled to the presumption of innocence, and we ask that everyone allow the legal process to unfold before drawing conclusions.”
The Palm Beach County Sheriff’s Office continues to investigate the incident and whether anyone else seen in the videos should face charges. Check back for updates later today.

His place of employment was confronted about his behavior and asked if he was still employed at the law firm in New York. Allegedly they told the concerned citizens to “get a life” and hung up. Aren’t law firms supposed to follow ethics? Hmmm all allegations but interesting.

That guy along with the other men and women that held the child refused to give his phone back all should be arrested and the parents of the child should definitely sue those families! This loser was actively looking to find a kid who he deemed to be a menace to the community and deal with it. This helmet wearing weakling targeted a young child he thought he could control. Every adult that restrained, touched, TRIPPED the minor child should be arrested. The people encouraging the adults to restrain, touched, trip the minor child should be investigated for abusing children. If the child was posing a safety risk, call the police.
