BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2024 MetroDesk Media, LLC) — A woman claims she tripped and fell in a model home at Lotus, one of the gated communities on Lyons Road just north of Clint Moore. She is now suing builder GL Homes, claiming the builder did a shoddy job building the model — and that she had no reason to expect it wasn’t level.

According to the suit just filed in Palm Beach County Circuit Court, Cheryl Briesemeister sustained critical injuries when she was touring the house at 17299 Pagoda Palms Drive.

“On or about March 11, 2023, while at, or and/in the home, model home, house, and/or structure, Cheryl Briesemeister was injured in and/or about her body after she tripped and fell over a very dangerous, unsafe and hidden deviation in elevation of the floor located in a media room of the subject model home. The model home … in the Lotus community unreasonably contained a dangerous condition, unsafe condition, and/or a hidden trap in the media room, to wit: hidden and disguised deviation in elevation. (It) continued a hidden and/or disguised deviation in elevation in the media room that created a trip and/or fall hazard.”

Attorneys for Brisemeister claim that their client sustained life-altering injuries.

“As a result of (Defendant’s) negligence, Briesemeister was injured in and about her body, suffered aggravation of pre-existing condition, pain, and suffering, disability, disfigurement, impairment of working ability, inconvenience, mental anguish, loss of capacity for the enjoyment of life and Plaintiff incurred medical expenses in the care and treatment of said injuries.”

The suit seeks in excess of $50,000 – the statutory minimum for filing in Palm Beach County Circuit Court. This appears to be the first lawsuit against G.L. Homes for a “hidden deviation” in a media room. Slanted media rooms — or media rooms with steps — are frequently featured in model homes built in G.L. Homes communities.

Briesemeister is represented by Scott Smith, Esq., of Smith, Ball, Baez and Prather.

  1. “Loss of capacity for the enjoyment of life”, now that’s where this makes no sense. What the h-ll does that mean? Not buying a few of the other things either but this loss of enjoyment, give me a break here. Looks like this is someone who found a way to try & make some money so she doesn’t have to work. And what better way then to go after a company with deep pockets! Such a shame that we live with folks like this who seem to have no moral compass who will try & sue for anything…because they can! Shameful and hopefully, the truth will come out.
