BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2024 MetroDesk Media, LLC) — A massage therapist is suing the owner of Dunkin’ Donuts at 9774 Glades Road, claiming a chair broke under her leading to catastrophic injuries. The Dunkin’ location, located next to the Home Depot near Glades and U.S. 441, is owned and managed by Best Donut, Inc.
According to the suit just filed in Palm Beach County Circuit Court, Christina Metts-Wakeland was eating at Dunkin’ on May 22, 2022. That’s when she attempted “to sit down at an outside dining table and chair. Without warning and unbeknownst to the Plaintiff, the chair had a broken leg. When Plaintiff sat down, the chair collapsed underneath the Plaintiff, causing her to fall backward and sustain injuries.”
The complaint alleges that Dunkin’ employees failed to inspect or “adequately inspect” the outdoor dining chair to ascertain whether the chair constituted a hazard to residents utilizing said chair.” The suit claims Mets-Wakeland sustained critical injuries.
“As a direct and proximate result of the negligence of Dunkin, Plaintiff suffered bodily injury in and about (her) body and extremities, resulting in pain and suffering, disability, disfigurement, permanent and significant scarring, mental anguish, loss of the capacity for enjoyment of life, expense of hospitalization, medical and nursing care and treatment, loss of earning, loss of ability to earn money, and aggravation of previously existing condition.”
Christina Metts-Wakeland is represented by Vanessa Irvin of Morgan and Morgan. She seeks in excess of $50,000, the statutory minimum for filing in Palm Beach County Circuit Court. Dunkin’ had not responded to the suit as of the afternoon of Monday, February 19, 2024.
