Lawsuit Claims Incompetent, Poorly Trained Staff At Nursing And Rehabilitation Facility.

BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2025 MetroDesk Media, LLC) — A resident at the Encore at Boca Raton was so poorly cared for that staff let him become malnourished to death. That’s the claim from a new lawsuit filed against the nursing and rehab facility at 7300 Del Prado Circle in Boca Raton. The suit claims that horrific care — or lack of care — led to the death of Frederic Sells back in August of 2023. This is at least the 15th nursing home negligence suit filed against the Encore At Boca Raton since 2019.
BocaNewsNow.com obtained the complaint filed in Palm Beach County Circuit Court. The following are key claims made by the family of Frederic Sells:
During FREDRIC SELSS’ residency at THE ENCORE AT BOCA RATON REHABILITATION AND NURSING CENTER, LLC, the staff and employees failed to develop an adequate care plan and properly monitor and supervise the care and treatment provided to FREDRIC SELSS in order to prevent him from suffering the development and deterioration of respiratory failure and from suffering the development and deterioration of malnutrition and weight loss. As a direct result of THE ENCORE AT BOCA RATON REHABILITATION AND NURSING CENTER, LLC’s acts and omissions, FREDRIC SELSS suffered the development and deterioration of respiratory failure and suffered the development and deterioration of malnutrition and weight loss.”
The suit also makes the following allegations against The Encore at Boca Raton: “failure to properly supervise FREDRIC SELSS; failing to provide adequate and appropriate protective and support services to FREDRIC SELSS; failing to develop, implement, and update an adequate and appropriate resident care plans to meet the custodial needs of FREDRIC SELSS; failing to maintain records which contain sufficient and accurate information to justify the diagnosis and treatment and to document the results, including at a minimum documented evidence of assessments of the needs of the resident, of establishment of appropriate plans of care and treatment, and of the care and services provided; failing to appropriately monitor FREDRIC SELSS and recognize significant signs and symptoms of change in his health status, such as suffering the development and deterioration of respiratory failure and suffering the development and deterioration of malnutrition and weight loss; failing to properly notify the family and physicians of FREDRIC SELSS’s of significant changes in his health status, such as suffering the development and deterioration of respiratory failure and suffering the development and deterioration of malnutrition and weight loss; failing to protect FREDRIC SELSS from foreseeable harm, including but not limited to suffering the development and deterioration of respiratory failure and suffering the development and deterioration of malnutrition and weight loss; failing to properly supervise staff; failing to properly train staff; improper retention of staff…”
The suit seeks in excess of $50,000 which is the statutory minimum for filing a lawsuit in Palm Beach County Circuit Court. The Selss family is represented by Attorney William Dean of Ford, Dean and Rotundo in North Miami Beach. No attorney is listed for the often-sued Encore at Boca Raton.

I was a patient there 5 years ago. They could not give me my meds because nurse locked her days in her car. It was late at night and could not get anyone to open the car.
One of my meds I could not take because the nurse said I already took it. The next day she applied that they ran out of the supply and that is why I did not get it. I signed out and wrote some scathing stuff and they were furious with me. I was told I could not write the complaints on the sign out forn.m. there were 2 Anita’s in my room. My dinners, lunches, etc. Kept getting mixed up and I had a hard time getting it rectified.
The only good information was the physical therapy part. They had their act together. When they had the name was Whitehall they was were a nuch better place. Organized and well trained. Their food were difficult to eat.
