The complaint, filed in Palm Beach County Circuit Court and obtained by BocaNewsNow.com, seeks damages in excess of $50,000 against Avante at Lake Worth, Inc.. The complaint alleges that the facility claimed to be equipped for complex respiratory care but failed to provide even basic emergency intervention when a resident’s condition turned critical.
The incident began in January 2024 when a woman was transferred to Avante from Boca Regional Hospital following a tracheotomy. According to court documents, family members visiting the facility observed the woman struggling to breathe, noting her face was visibly swollen and her cheeks were puffed out. Despite these clear signs of distress and failing oxygen levels, the lawsuit claims the staff did not call 911, did not transfer her to a hospital, and left her overnight without escalating her medical care.
The situation turned fatal the following morning when staff finally found the resident unresponsive. By the time emergency medical services were contacted and arrived, it was too late, and she was pronounced dead at the facility. The lawsuit accuses Avante of multiple counts of negligence, including a failure to properly monitor respiratory conditions, a lack of adequate staff training, and a violation of Florida’s nursing home resident rights.
Represented by the law firm Florin Gray, the estate is seeking compensation for mental pain and suffering, medical and funeral expenses, and the loss of parental companionship for the woman’s surviving children. The facility is located at 2501 North A Street in Lake Worth. Avante had not filed a response to the suit processed by the Palm Beach County Clerk of Courts as of Sunday morning.
