BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2026 MetroDesk Media, LLC) — The Fairfield at Boca Association has filed a multi-count lawsuit against the owners and managers of Boca Center, alleging that a neglected drainage system is causing significant physical damage to the residential community. The complaint, filed in Palm Beach County Circuit Court and reviewed by BocaNewsNow.com, claims that stormwater runoff from the neighboring commercial property has led to severe erosion, washouts, and exposed pipes along the association’s lake banks. 

At the heart of the dispute is a 1999 perpetual drainage easement that allows the Boca Center property to discharge water into a retention pond on Fairfield’s land. While the agreement states that the commercial owners are responsible for a “proportionate share” of maintenance costs, the specific percentage was left blank in the original document. Fairfield’s legal team argues that because the commercial defendants are the sole users of this specific drainage outfall, they should bear the full burden of repair costs, which are currently estimated at $130,500. 

The Association claims it first warned the defendants—including MPF Vanderbilt Boca Property, LLC—about the deteriorating conditions in August 2024.

Despite an initial response in December 2024 where the defendants acknowledged their reimbursement obligations and promised an engineering inspection, Fairfield alleges no repairs have been made. The lawsuit describes the current state of the property as an “attractive nuisance” and a safety hazard for the hundreds of children living in the community.
