Heavenly Bed Or Debt From Hell?

BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2026 MetroDesk Media, LLC) — Marriott Resorts Hospitality Corporation has filed a lien foreclosure lawsuit in Palm Beach County against two deceased timeshare owners — including a man who died more than five years ago — over unpaid maintenance fees totaling more than $30,000. The complaint, filed May 11 and obtained by BocaNewsNow.com, names William F. Brighoff, who died November 16, 2019, and Carol R. Bartell, who died March 2, 2024, as defendants across three separate timeshare units at Ocean Pointe at Palm Beach Shores Condominium.
The suit alleges both owners failed to pay maintenance fees that came due January 25, 2024 — more than four years after Brighoff’s death. Just to say it another way: Marriott wants a dead person to pay for maintenance fees incurred after the person died.
Marriott, acting as management agent for the Ocean Pointe Condominium Association, claims $10,311.57 per unit on three separate timeshare weeks, plus 18 percent annual interest, attorney’s fees, and court costs. The three units involved are Week 32 in Unit 8602, Week 23 in Unit 8606, and Week 29 in Unit 8608.
Because both owners are deceased, Marriott is also targeting any unknown heirs, devisees, grantees, creditors, or other claimants who may have an interest in the properties. The company attached death records for both defendants to the complaint and an obituary. The deaths are not in dispute.
Attorney Edward M. Fitzgerald of Holland & Knight LLP in Orlando represents Marriott which — apparently — is much like the Hotel California. You can check out but you can never leave.
