
BOYNTON BEACH, FL (BocaNewsNow.com) (Copyright © 2026 MetroDesk Media, LLC) — The daughter of a man who died in May is suing Brookdale West Boynton Beach, claiming staff at the assisted living facility let him develop pressure wounds, infections and sepsis before his death. Kimberly Duker, the personal representative of the Estate of Mark Heifferman, filed the wrongful death complaint Wednesday in Palm Beach County Circuit Court.
The suit, obtained by BocaNewsNow.com, names Summerville 15, LLC, which does business as Brookdale West Boynton Beach, and Brookdale Senior Living, Inc., described as the facility’s management company. According to the complaint, Heifferman was admitted for care related to ongoing medical conditions and cognitive changes, and he depended on staff for help with daily living. The filing says he suffered pressure injuries to his backside and lower extremities, a urinary tract infection, facility-acquired infections, sepsis, dehydration, malnutrition and falls. He died May 12, 2026.
Duker alleges both companies violated Heifferman’s rights under Florida statutes which govern assisted living facilities. The complaint lists 30 alleged failures, from not preventing skin breakdown and falls to not notifying family of his declining condition, not transferring him to a higher level of care and not keeping him clean. It also accuses the defendants of understaffing the facility and failing to budget properly for it.
The four-count lawsuit seeks wrongful death and survival damages exceeding $50,000, along with a jury trial. Duker is represented by William J. Sarubbi II of Senior Justice Law Firm in Boca Raton. The complaint is published, below.
