BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2022 MetroDesk Media, LLC) — A woman who claims she was critically injured while riding a Go-Kart at Boomers in Boca Raton is now suing Boomers and its parent company, “APX Boomers.”

The lawsuit, just filed in Palm Beach County Circuit Court, alleges that Julia Perez was not provided with “basic safety equipment, including but not limited to a helmet.” She also claims that the seatbelt in the Go-Kart was “broken and/or malfunctioning.”

Also from the suit: “The Defendant, APX Boomers Boca Raton LLC, by and through its agents, servants and/or employees, had actual knowledge, or in the alternative, that the dangerous condition existed for a sufficient length of time so that (Boomers) had constructive knowledge and should have known of the dangerous condition by conducting a reasonable inspection of the premises prior to the Plaintiff, Julia Perez, being injured.”

Attorneys for Perez state that, “as a direct and proximate result of the negligence of (Boomers), Julia Perez suffered bodily injury and resulting pain and suffering, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, expense of hospitalization, medical and nursing care and treatment, loss of earnings, and loss of ability to earn money. The losses were either permanent or continuing in nature.”

The suit seeks in excess of $30,000, the statutory minimum for filing in Palm Beach County Circuit Court. Read the complete filing, below. Perez is represented by Barket Lawyers in Miami.
