Student Allegedly Suffers From ADHD. Parent Claims School Unwilling To Make Accommodations. Expelled.

DELRAY BEACH, FL (BocaNewsNow.com) (Copyright © 2023 MetroDesk Media, LLC) — A Delray Beach man is suing an area private school, claiming his son is being harassed and targeted by staff members unwilling to deal with the child’s ADHD diagnosis. The child was just expelled.
Marc Poulshock is suing the Weiss Gifted and Talented School — a private school in Palm Beach Gardens. The school is a private business. Like all private schools, it largely sets its own rules and regulations. Parents agree with those rules and regulations when they into a contract for enrollment.
The suit claims that Mr. Poulschock’s child was diagnosed with Attention Deficit Hyperactivity Disorder. Instead of creating a plan and working with the child to best handle his diagnosis, Poulshock claims that staffers targeted the child in an effort to have him removed from the school. The suit claims that the child was accused of saying “c–k sucker,” a claim later rescinded. And then he was accused of saying “69” in a manner unrelated to a mathematical equation. Mr. Poulschock was told that his child could only stay in the school if a “behavior contract” was signed. Mr. Poulschock declined to sign the contract.
According to the lawsuit, Mr. Poulschock claims that his child was, separately, physically attacked in the school, but the attacker received no discipline — and no “behavior” contract was required for his alleged attacker. He claims his child is being singled out.

“It is egregious enough that this particular student was not expelled, but the Weiss school did not force a behavior contract on this particular student as it has attempted to do to (Mr. Pouschock’s child),” states the complaint reviewed by BocaNewsNow.com. “Upon information and belief, this other student does not suffer from a qualifying disability. Further, Weiss’s agents and/or employees were made aware of MPs disability. The allegation concerning his repeating the phrase “69”, and subsequent disciplinary action is retaliatory based on MPs disability.”
Mr. Poulschock’s son was expelled which is what led to the suit. Mr. Poulschock claims it’s too late in the school year to enroll in public school, and no private school will take a child expelled from Weiss. The suit seeks an injunction permitting the child to remain at Weiss, and damages in excess of $50,000. Mr. Poulschock is represented by attorney Nathan Soowal of Pompano Beach.
