BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2023 MetroDesk Media, LLC) — A customer of Duffy’s Sports Bar at Glades Road and U.S. 441 in Boca Raton is suing Duffy’s parent company after allegedly being critically injured in a bar brawl. Workers apparently did nothing as the fight ensued after the customer asked three men — with a young child — to control the child who was sitting at the bar.
The suit, which seeks in excess of the statutory minimum of $50,000, alleges that the restaurant was out of control with workers paying no attention to customers and the bartender paying no attention to a young child sitting at the bar and allegedly causing chaos. The incident, apparently caught on video, is described in the complaint reviewed by BocaNewsNow.com.
“In that video, what we all observed was a group of three men sitting at the end of the bar, along with a small minor child, who was also sitting, standing, dancing around, and making a mess of things at the bar. We observed the male who eventually started the melee and injured Mr. Liberatore drink heavily and bounce around the area and in his seat in a manner indicative of a person seriously under the influence of alcohol and intoxicated.
We observed an inattentive bartender who only sporadically came into view to attend to the patrons at the bar area. We observed the minor child with the three men behaving inappropriately, causing a raucous, and interfering with other patron’s ability to enjoy their time at Duffy’s, as paying customers. The child was up on the bar stools, making noise, making a mess. We observed a bartender and other restaurant personnel so inattentive that patrons who had been delivered their food to their table without utensils, going to the bar and taking utensils from the bar because the service was nearly nonexistent.
We observed a patron ask one of the men with the unruly child to tend to that child so he and other patrons could enjoy their paid-for experience at Duffy’s. We observed the men with the minor child start a melee in response thereto. At least one of the men accompanying the minor child was known to Defendant as a regular, part of the Duffy’s reward program.”
According to the complaint, “As a direct and proximate result of the Defendant’s negligence detailed above, the Plaintiff suffered serious bodily injury and resulting pain and suffering, disability, disfigurement, mental anguish, significant and permanent scarring, loss of capacity for the enjoyment of life, expenses of hospitalization, medical and nursing care and treatment, loss of earnings, and loss of ability to earn money.”
Duffy’s Holdings, the official name of the defendant, did not immediately respond to the suit.
