CLAIM: Hotel Approved Late Check Out. But Rummaged Room Instead.

BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2023 MetroDesk Media, LLC) — Marriott Corporation (NASDAQ: MAR) is facing a lawsuit in Palm Beach County Small Claims Court over miscellaneous charges assessed to someone’s bill, two tee-shirts that vanished, and a missing pair of jeans. The lawsuit was filed just as 2023 comes to a close.
According to the complaint obtained by BocaNewsNow.com, Ernest Braya of Boca Raton was using gift cards to spend several nights at the Residence Inn located at 525 NW 77th Street in Boca Raton. A Titanium member of the Marriott’s loyalty program — that’s the top level — Mr. Braya said he was granted a late checkout on his final day. But when he returned to his room on the afternoon of May 2, 2023, the keycard wouldn’t work. And hotel employees had taken his personal possessions and cleaned out the room.
“As to my lost belongings I requested the hotel’s representative in advance, the day before, about late check out (4 p.m.) on my last day of the stay, 05.02.23 (holding Titanium elite status I’m eligible for a late check out),” wrote Braya in the suit. “The representative of Defendant 1 approved my request. Much to my regret, on 05.02.23 at 3:30 p.m. the door of my hotel apartment was locked, my key card wasn’t active, and my belongings were taken out. Lately, I retrieved my stuff from hotel’s employees. Regrettably, I found that some of my stuff, two T-shirts and jeans, were lost. The cost of my lost belongings is $100.”
The hotel, according to the suit, also posted several unexplained charges to Mr. Braya’s credit card. While the folio shows payment with gift cards, the hotel claims to not know where the additional charges came from. It was unclear if Mr. Braya disputed the charges with his credit card bank.
The suit seeks $441 to cover the lost clothing and excess charges. Mr. Braya also seeks $50 for “moral damage,” and notes in the complaint: “You Shall Not Steal (Exodus 20:15; Deuteronomy 5:19). Marriott has not responded to the claim.

I lost a pair of sneakers several years ago in a hotel. If it fits the staff or their children you will never see your items again!!!! They had no need for the neck brace I wore so it turned up in lost and found.
