BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2024 MetroDesk Media, LLC) — A major lawsuit just filed in Palm Beach County Circuit Court accuses the Trustees of Advent Lutheran Church of neglecting a patient in the Advent Square Nursing Home on Dixie Highway in Boca Raton. The neglect, according to the suit, was so egregious that the patient died.

According to the complaint obtained by BocaNewsNow.com, Zena Mundy was a known “fall risk” and was supposed to be cared for by professionals who are trained in dealing with the patients who are susceptible to falls. But the workers, according to the suit, were so incompetent at Advent that ignored dangerous situations that ultimately led to Ms. Mendy’s death after a fall that led to a displaced fractured shoulder.

From the lawsuit: “As a direct and proximate result of the negligence of Defendant ADVENT, ZENA MUNDY died on April 30, 2022. As a direct and proximate cause of the negligent assisted living facility care and rights violations of Defendant ADVENT, ZENA MUNDY suffered a fall that caused her injuries, including bodily injury, pain, suffering, inconvenience, loss of dignity, disability, disfigurement, mental anguish, loss of the capacity for the enjoyment of life, aggravation of previous existing conditions, all of which continued from the day of her fall to the date of her death.

As a direct and proximate result of the negligence of Defendant ADVENT, the decedent’s spouse, LECENT MUNDY, has suffered loss of companionship and protection and mental pain and suffering, and will continue to suffer such pain and losses for the rest of his life. Medical and funeral expenses due to ZENA MUNDY’s injury and death were also incurred. The Estate of ZENA MUNDY is seeking all recoverable damages including, but not limited to, medical and nursing expenses, burial and funeral expenses, and loss of net accumulations from the day of her fall to the date of her death. The Estate of ZENA MUNDY seeks all recoverable non-economic damages for the decedent.”

Ms. Mundy’s estate is represented by the Shevin Law Firm in Boca Raton. The Lutherans have not yet filed a response that has been processed by the Palm Beach County Clerk of Courts.

  1. On the flip side of this lawsuit, if yhe victim’s family wins a massive settlement, it is possible that this nursing home will go under from not being able to pay insurance premiums. There is already such a shortage of old age care everywhere. Waitlists. And a shortage of health care workers too
