DELRAY BEACH, FL (BocaNewsNow.com) (Copyright © 2024 MetroDesk Media, LLC) — Another resident of Seven Bridges in Delray Beach is now living in a federal prison. Brett Hirsch is the latest resident of the G.L. Homes community on Lyons Road north of Clint Moore to give up a 5200 square foot home for the confines of a cell in the federal prison system.

Hirsch was indicted back in 2019 on Medicare fraud. He, according to prosecutors, took part in a massive scheme involving genetic testing. The complete indictment is below. Hirsch entered a guilty plea and offered the following “proffer” to the Department of Justice.

”Beginning in or around approximately January 2017 and continuing through approximately June 2019, in Palm Beach County, the Southern District of Florida, and elsewhere, the defendant, BRETT HIRSCH (“HIRSCH”), knowingly and willfully conspired and agreed with others to’ solicit and receive illegal health care kickbacks, in violation of Title 18, United States Code, Section 371. Medicare is a “health care benefit program” as defined in Title 18, United States Code, Section 24. Furthermore, Medicare is a health care benefit program affecting commerce.

“HIRSCH owned and operated Alite Medical Solutions, LLC, a Florida corporation with its principal place of business in the Southern District of Florida. HIRSCH was a patient broker who referred Medicare beneficiaries to laboratories in exchange for bribes and kickbacks: The laboratories included LabSolutions, LLC, Clio Laboratories, LLC and Performance Laboratories LLC (the “Labs”). In exchange for referring the beneficiaries to the Labs, the Labs paid the Defendant a kickback based on a set percentage of the amount they received from Medicare for performing the tests. These kickbacks were paid to HIRSCH and Alite Medical Solutions, LLC. by means of cash and by check and wires. From January 2017 to June 2019, HIRSCH was paid approximately $2,532,242 in kickbacks.”

“HIRSCH referred the Medicare beneficiaries to the Labs for genetic testing. HIRSCH understood that the tests were not medically necessary, and that the tests were not ordered by a physician treating the beneficiary for any specific medical problem, symptom, illness or diagnosis. Instead, HIRSCH knew that the beneficiaries were recruited in a variety of ways, including through call centers and health fairs, to receive the tests. HIRSCH understood that the tests were ordered by doctors, including telemedicine doctors, who were not going to use the results in the management of the beneficiary’s specific medical problems. HIRSCH knew that the Labs billed Medicare for the genetic tests. HIRSCH also recruited other individuals to refer beneficiaries to the Labs. Defendant received an “override” fee from the Labs, which equated to a percentage of the amount the Labs received from Medicare for performing the tests, for beneficiaries those individuals referred to the Labs.“

Despite the guilty plea, Hirsch’s case moved in slow motion through the federal court system. That’s until May, when a judge told Hirsch he had to report to federal prison by June 4th. He is now incarcerated at the federal prison camp in Montgomery, Alabama. His prisoner number is 48361-054.

In addition to his sentence of roughly two years, Hirsch must pay restitution in the amount of $2,532,242. According to a document obtained by BocaNewsNow.com and written by United States District Judg Rodolfo Ruiz, “In support of the guilty plea, the Defendant executed a Factual Proffer, and the Court found that there was a factual basis to support the Defendant’s conviction. The Factual Proffer also provided a basis for the forfeiture of property. Based on the record in this case, the total value of the gross proceeds traceable to the offense of conviction is $2,532,242.00 which sum may be sought as a forfeiture money judgment pursuant to Rule 32.2 of the Federal Rules of Criminal Procedure.”

Hirsch, 58, whose home address is listed as a home in the 9800 block of Vitrail Lane in Delray Beach, is set to be released in August of 2026. He is the latest Seven Bridges resident to relocate from New York to Seven Bridges, only to end up in federal prison. Among the others: a Chiropractor who engaged in Medicare fraud. A moving company owner. A fitness supplement distributor. A boiler room operator. And so many more. Read our previous Seven Bridges Delray Beach coverage here. Download the indictment, below.
