The Encore At Boca Raton Rehabilitation and Nursing Center has reported 48 COVID-19 Deaths, according to the Florida Dept. of Health.

BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2021 MetroDesk Media, LLC) — A lawsuit just filed in Palm Beach County alleges that an area nursing home was so ill-prepared for COVID-19, and handled it so poorly, that a preventable outbreak in the facility led to the death of a resident.

The Encore at Boca Raton is accused of incompetently handling COVID-19 and failing to put protocols into place to protect residents like Mamie Myers. While the lawsuit just filed focuses on Myers, the State of Florida reports that Encore At Boca Raton Rehabilitation And Nursing Center has recorded 48 resident deaths related to COVID-19 as of May 23rd, 2021. Only three facilities in the entire state of Florida have reported more COVID-19 resident deaths.

Myers tested positive for COVID-19 on August 7th, 2020. She died a week later. Myers was confined to The Encore — there is no other place she could have contracted COVID, according to the suit.

Attorneys representing her family make the following allegations:

“THE ENCORE AT BOCA RATON REHABILITATION AND NURSING CENTER, LLC provided negligent nursing home care and violated MAMIE MYERS’s rights under Chapter 400, Florida Statutes, by: a. Failing to implement proper infection protocol (s) within facility; b. Failing to provide a healthy, disease-free environment for MAMIE MYERS; c. Failing to perform regular testing on staff (to ensure) COVID-19 did not spread within the facility from staff member staff member or resident; d. Failing to take all necessary precautions to prevent residents from contracting COVID-19; and. Failing to enforce staff correct and continued use of PPE equipment; F. Failing to prevent outsiders from coming into the facility despite “lockdown”; g. Failing to protect MAMIE MYERS from foreseeable harm causing death; h. Failing to provide care and treatment to MAMIE MYERS within the standard Failing to act reasonably in light of the circumstances.”

The suit, filed by attorney Lindsey Gale of Domnick Cunningham and Whelan in Palm Beach Gardens, seeks in excess of the statutory minimum of $30,000. No immediate response was filed by attorneys representing Encore.

The Encore At Boca Raton Rehabilitation And Nursing Center is located at 7300 Del Prado Circle South in Boca Raton.
