POLICE: Breath Alcohol Three Times Legal Limit.

DELRAY BEACH, FL (BocaNewsNow.com) (Copyright © 2021 MetroDesk Media, LLC) — A Delray Beach man is facing a DUI charge following his arrest on Sunday.
Wade Shaughnessy, according to police, was weaving back and forth on South Ocean Blvd just past midnight on Sunday, in Delray Beach, when he was stopped by police. This is part of the the narrative written by the DUI investigator:
“The following occurred in the City of Delray Beach, County of Palm Beach, FL. On 08/29/21 at 0012hrs, Ofc. E. Hernandez # 1194 DBPD observed a black 2018 Ford F-150 (FL Tag # RLV410) traveling eastbound in the 1100 block of Casuarina Rd. The Ford was traveling in the middle of the roadway which is configured for one westbound travel lane and one eastbound travel lane. The Ford turned right (south) onto S. Ocean Blvd. and accelerated a high rate of speed. The Ford crossed the double yellow line several times on S. Ocean Blvd.
S. Ocean Blvd. is configured with one northbound travel lane and one southbound travel lane.
Ofc. E. Hernandez established a pace of speed for the Ford in the 700 block of S. Ocean Blvd. The Ford was traveling 55mph in a posted 35mph speed zone. Ofc. E. Hernandez activated his emergency lights on his marked DBPD patrol vehicle and conducted a traffic stop at S. Ocean Blvd. and Del Haven Dr. Ofc. E. Hernandez met with the white male driver and identified him by his FL DL as Wade Charles Shaughnessy. Shaughnessy was sitting in the driver seat with the engine running and vehicle key in the ignition. There was a white female in the front passenger seat. I arrived on scene to conduct a DUI investigation. I met with Shaughnessy who was sitting in the driver seat of the Ford.
OBSERVATION OF DRIVER: I smelled an odor of an unknown alcoholic beverage coming from Shaughnessy. Shaughnessy’s eyes were red and he had a glassy appearance. Shaughnessy’s eyelids were droopy and he appeared to have difficulty keeping his eyes open. Shaughnessy had slow dexterity and response to questions. Shaughnessy’s speech was slurred and thick. There was an open box of Funky Buddha Seltzer (alcoholic beverage) on the rear seat in plain view. Shaughnessy was unsteady on his feet when he exited the Ford. Shaughnessy swayed in a circular motion while standing still. After exiting the Ford, I still smelled an odor of an unknown alcoholic beverage coming from Shaughnessy.”
“Shaughnessy stated he began driving at the Sandbar (40 S. Ocean Blvd., Delray Beach, FL.). Shaughnessy initially stated he had consumed 5 beers between 1100hrs and 2330hrs. Shaughnessy stated the beers he consumed were in a bottle. Shaughnessy later stated he consumed five to six beers but he was unsure exactly how many drinks he consumed. I asked Shaughnessy about the open box of Funky Buddha and he stated that it was the beers he was consuming.”
The Delray Beach Police report states that Shaughnessy provided breath alcohol samples of .243 and .244. The legal limit in Florida is .08. He was charged with “DUI Unlawful Blood Alcohol — DUI Breath Alcohol .08 or more per 210L.” He was booked into the Palm Beach County Jail and later released on his own recognizance.
