Palm Beach County Parents Say School District Mask Mandate Is Unfair. Mask Mandate Ended Monday.

BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2021 MetroDesk Media, LLC) — The Palm Beach County School District’s mask mandate officially ended before school started on Monday, but that didn’t stop a group of parents from filing a new lawsuit against the school board for ever imposing a mask mandate.
The lawsuit, which you can read in its entirety below, rehashes many of the same complaints, arguments and, in some cases, conservative news channel talking points, to claim that masks are useless and parents should be able to let their children spread germs to other kids because they have a right to spread germs.
Snark and common sense aside, here is the core of the anti-maskers’ argument:
“If school boards, including Respondent School Board of Palm Beach County, and its Superintendent, Respondent Burke, can simply make up their own rules and ignore Florida law and the Florida Department of Health’s guidelines for public schools, then the entire constitutional system of government of Florida and the rule of law becomes irrelevant. The Palm Beach County School Board has without legal authority created its own laws, independent of the Department of Health which remain adverse to Florida law and the Department of Health. This lawlessness sets
dangerous precedent, if permitted to stand by this Court. Accordingly, this Honorable Court should issue a writ of mandamus directing the Respondents to immediately comply with the Florida Department of Health’s Emergency Rule and afford all students’ parents and guardians in the District with the ability to opt-out of the Respondents’ mask mandate policy at their sole discretion, as required by Florida law.”
The lawsuit calls on the school district to provide parents and guardians the ability to “opt out” their children. Ironically, that was already in effect before the lawsuit was processed by the Clerk of Courts.
