BOYNTON BEACH, FL (BocaNewsNow.com) (Copyright © 2022 MetroDesk Media, LLC) — Valencia Bay builder GL Homes, and its contractor “Signature Design Paving Corporation of South Florida,” are being accused of shoddy construction and construction management by a homeowner who claims their bad work led to his injury.
Robert Gottlieb says he slipped and fell in his garage which was accumulating water from the outside. The incident occurred on or about April 11, 2018. Gottlieb and his wife purchased the new home from G.L. Homes for $913,000 in June of 2017. While the legal description of his home is “Valencia Cove,” the home is actually in “Valencia Bay” which is its own gated community.
According to the lawsuit just filed in Palm Beach County Circuit Court, “Defendant G.L. Homes of Florida had a duty to maintain the premises in a reasonably safe condition, correct any dangerous condition of which it either knew or should have known by the use of reasonable care, and to warn of any dangerous conditions concerning which it had, or should have had, knowledge greater than that of its invitees. Specifically, G.L. Homes of Florida and Signature Design Paving negligently:
“Failed to build the driveway, dwelling, and garage in a safe manner; failed to build the paver driveway and slope of the paver driveway in a safe manner; failed to construct the new home in a safe manner so that water, rain, and/or liquid did not drain and accumulate in the garage; failed to build the garage floor in a safe manner; failed to build the dwelling and garage in a safe manner so that water and rain did not drain, and accumulated in the garage; and failed to repair the water draining issue after being put on notice.”
The suit also states that G.L. Homes and Signature Design Paving were notified of the problem, attempted to fix the problem, but failed. As a result of the issue, Mr. Gottlieb: “suffered bodily injury and resulting pain and suffering, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, expense of hospitalization, medical and nursing care and treatment, and aggravation of a previously existing condition.”
There was no immediate response filed by either G.L. Homes or Signature Design Paving. G.L. Homes is a major South Florida builder, responsible for several notable communities including The Bridges, Seven Bridges, Boca Bridges, Dakota, Lotus, and Valencia-branded communities.
According to local Real Estate Firm ZFC, “Valencia Cove is a single family residence community located in Boynton Beach Florida with a range of options priced between $669,900 and $1,050,000.” Learn more about Valencia Bay.
