BOYNTON BEACH, FL (BocaNewsNow.com) (Copyright © 2023 MetroDesk Media, LLC) — A man was disfigured and lost his capacity for his enjoyment of life after falling on gravel on the pickleball courts at Valencia Lakes in Boynton Beach — at least that’s the claim in a lawsuit just filed in Palm Beach County Circuit Court.

According to the complaint, Sidney Sharp was an “invitee” to Valencia Lakes in March of 2019 when he was “forced” to slip and fall on the courts. The word “forced” is not often seen in a slip-and-fall case, but it is the word used in the following section of the official complaint.

“On or about March 26, 2019, while exercising due care and caution for his own safety, the Plaintiff was an invitee within the Defendant’s so-called “recreation complex” when he was forced to slip and fall on a pickleball court due to the Defendant’s negligent maintenance thereof and failure to warn of the dangerous conditions thereon.

The Defendant and their agents and/or employees owed to the Plaintiff a duty of reasonable care to maintain the Premises in a condition reasonably safe for its intended use and free from all conditions which would render them dangerous and unsafe for the Plaintiff, or present an unreasonable risk of harm in the Plaintiff’s lawful use of same. More specifically, the Plaintiff was lawfully utilizing said pickleball court when he was forced to slip and fall due to minuscule, gravel-like debris thereon, that of which is tantamount to a latent defect.”

Mr. Sharp also claims that among the problems leading to his injuries, “(Valencia Lakes) failed to post even basic safety instructions pertaining to the proper use, operation, and physical maneuvering, on a pickleball court such as that on Defendant’s premises.” The suit does not explain why Mr. Sharp was using a pickleball court if he needed instruction on how to use a pickleball court.

Sydney Sharp, according to the suit, suffered serious injuries and continues to be affected by his fall. He seeks in excess of $100,000. Sharp is represented by Attorney Wesley Colgan III of Miami. Read the complete filing, below.
