BurgerFi Boca Raton Sued Over Bathroom Incident

BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2023 MetroDesk Media, LLC) — A BurgerFi customer claims that he was critically injured during an incident in the bathroom at the restaurant’s location on SW 18th Street in Boca Raton.

According to the complaint obtained by BocaNewsNow.com, Gerard Turner was using the bathroom in the restaurant at 6919 SW 18th Street on March 15th, 2022. Unbeknownst to him, according to the suit, the bathroom plumbing was leaking — leaving water all over the floor. Turner — not expecting water everywhere — slipped and fell, critically injuring himself.

Among the allegations made in the suit: “The Defendant failed to conduct adequate inspections of the Premises, when with reasonable timely inspections Defendants would have identified the water left on the floor; The Defendant negligently failed to clean and dry the water which had been left on the floor for such an unreasonable length of time that it had already been walked on and tracked through, putting Defendant on constructive if not actual notice of the dangerous condition; The leak had been ongoing for so long that the area of the floor where the water was yellowed, indicating that the condition occurred with regularity and was therefore foreseeable; and The Defendant failed provide adequate warning of the presence of the water on the floor which it knew or should have known was there.”

The suit claims that Turner was so injured, he required nursing care and continues to suffer from disability. His suit seeks in excess of $30,000 — the statutory minimum for filing in Palm Beach County Circuit Court. BurgerFi, as of late Monday afternoon, did not file a response to the lawsuit. Turner is represented by Miami Attorney Jose Francisco.
