PALM BEACH COUNTY, FL (BocaNewsNow.com) (Copyright © 2023 MetroDesk Media, LLC) — A woman claims she was critically injured in a shopping cart incident at a Palm Beach County Walgreens. She is now suing the Florida-based company.
Nancy Fulk, who lives in St. Lucie County, says she was shopping at a Walgreens in Palm Beach County when something went terribly wrong with a shopping cart. Wrote her attorney in the lawsuit that was just filed in Palm Beach County Circuit Court:
“At said time and place, the Defendant, or its agents, servants and/or employees acting within the scope and course of such agency, service or employment, negligently maintained the shopping cart which was being used by the Plaintiff to be in a state of disrepair so that it constituted a dangerous and unsafe condition which resulted in the Plaintiff tripping and falling. Further, at the time and place the Defendant, Walgreens Store failed to warn the Plaintiff of said dangerous condition and failed to place any type of warning cone or other device.”
According to the suit, Fulk suffered bodily injury resulting in pain and suffering, impairment, permanent injury, and disfigurement. She also, according to the suit, suffered “mental anguish” as well. She is represented by attorney Stuart Goldenberg of the law firm of Lichtblau and Goldenberg in North Palm Beach.
