WANTS RESIDENT KICKED OUT, FORCED TO PAY LEGAL FEES… CRACKDOWN AS MORE THAN 25 RESIDENTS JAILED IN 15 MONTHS.

DELRAY BEACH, FL (BocaNewsNow.com) (Copyright © 2023 MetroDesk Media, LLC) — Apparently frustrated with more than a year of bad press now that at least 26 Kings Point residents have been arrested in just 15 months, an association within the senior living community is suing a resident who apparently shouldn’t be living there.
Saxony M Association, Inc., which is named for one of the sections of Kings Point, is suing Emmanuela Jean-Charles and Rose Marie Jean-Charles.
BocaNewsNow.com obtained a copy of the lawsuit just filed by the Association — this is a key section: “
Defendants have violated and are violating restrictions on occupancy in the Declaration. The Saxony M Condominium is a 55 and over, housing for older persons community. Defendants are violating Article XII of the Declaration which provides that “no occupancy shall be permitted by individuals between the ages of eighteen (18) and fifty-five (55) unless the Unit is also occupied by at least one person fifty-five (55) years of age or older.” The date of birth for Defendant Emmanuela Jean-Charles is December 25, 1977. The date of birth for Defendant Rose Marie Jean-Charles is October 17, 1944. Defendant Emmanuela Jean Charles, who is under 55 years old, resides in the Unit alone and has resided in the Unit alone for a significant period of time.
Defendants have violated and are violating the Declaration by creating a nuisance in connection with a dog. Defendants keep a dog in the Unit which Defendant EMMANUELA JEAN-CHARLES lets outside on the common elements while not on a leash. The Condominium is a housing for older persons community where the residents are older and many are elderly and many are unsteady on their feet. Residents are concerned about dogs being unleashed. Allowing the dog to go on the common elements unleashed constitutes a nuisance and a violation of Article XII of the Declaration.”
