BOYNTON BEACH, FL (BocaNewsNow.com) (Copyright © 2023 MetroDesk Media, LLC) — Krispy Kreme Doughnuts is facing a lawsuit in Palm Beach County Circuit Court after an employee — driving a Krispy Kreme truck — allegedly slammed into a motorcyclist in Boynton Beach.
According to the lawsuit obtained by BocaNewsNow.com, Krispy Kreme employee Javier Perez, “maintained the said motor vehicle in a negligent manner so as to cause it to collide and/or strike a motorcycle operated by Plaintiff Carmen Nichols.”
The incident happened, according to the complaint, on March31st around 5 a.m. in the area of Old Boynton Road near State Road 804. The suit claims that Nichols was critically injured in the crash — and that his motorcycle was nearly destroyed.
“As a direct and proximate result of the negligence of the Defendants, as aforesaid, Plaintiff, CARMEN NICHOLS, suffered bodily injury and resulting pain and suffering, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, expense of hospitalization, medical and nursing care and treatment, loss of earnings, loss of ability to earn money and aggravation of a previously existing condition. The losses are either permanent or continuing in nature and Plaintiff, CARMEN NICHOLS, will suffer the losses in the future.

Plaintiff’s motorcycle was damaged and he lost the use of it during the period required for its repair or replacement.”
We note that there is no record in the Palm Beach County court system of Javier Perez receiving a citation from police following the crash. The suit names “Krispy Kreme Doughnut Corporation, Krispy Kreme of South Florida, and Penske Truck Leasing Corporation” as co-defendants. Read the complete suit here.
