UPDATE: 5:31 P.M.: BocaNewsNow.com has learned that an attorney for Brandon Labiner instructed Labiner to sign a form stating that he was a U.S. Attorney, Federal Judge, or Federal Magistrate Judge to prevent law enforcement from releasing his booking photo. There is no indication that Labiner ever was a United States Attorney, Federal Judge, or Federal Magistrate Judge. Labiner is currently a disbarred attorney in State of Florida. The Palm Beach County Sheriff’s Office, which oversees the jail, apparently accepted the form at face value. We have reached out Mr. Labiner’s Attorney, Val Rodriquez, for clarification. He did not respond to our request. We have obtained the form signed and filed.

BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2023 MetroDesk Media, LLC) — The Boca Raton Police Department is again withholding public information, claiming that the information is exempt under “Marsy’s Law.” The information — the identity of a murder suspect and the suspect’s victim — was reported by BocaNewsNow.com Sunday evening. While the Palm Beach County Jail confirms our reporting, the Boca Raton Police Department inexplicably is unwilling to confirm that Brandon Labiner is accused of killing his father, Paul Labiner.

Both Paul and Brandon are attorneys. According to sources familiar with the investigation — and astonished that Boca PD is again claiming “Marsy’s Law” in an effort to withhold information — the younger Labiner met his father near the father’s law office at 5499 North Federal Highway on Saturday afternoon. Brandon Labiner then shot and killed his father, Paul Labiner, and fled the scene. He was later taken into custody in the 900 block of Federal Highway. Paul Labiner was in the midst of a lawsuit against his son who he called a “subpar” attorney.

We note that while Boca Raton Police withholds information, other Palm Beach County agencies are complying with Florida Statute 119 which requires the release of certain information. The Palm Beach County Jail provided BocaNewsNow.com with confirmation of Brandon Labiner’s booking.

Read the highly redacted police report here. This is the official media release issued by Boca Raton Police Monday morning. We note that Boca Raton Police refused to provide information regarding a murder suicide roughly one year ago.

“A 34-year-old male remains in the Palm Beach County Jail after being charged with Premeditated First-Degree Murder with a Firearm. The victim, who appeared to have been shot multiple times, was located by a family member in a breezeway near the parking garage at 5499 N Federal Highway around 4:30 p.m. on Saturday, July 1, 2023. The victim died at the scene.

After gathering information, Boca Raton Police investigators identified a person of interest in the victim’s death and determined that subject had an active warrant out of Broward County. Investigators attempted to make contact with the subject at 900 N Federal Highway where he barricaded himself within the building. The SWAT Team and Crisis Negotiation Team responded to the scene. Crisis Negotiators spoke with subject’s attorney who assisted officers with having the subject exit the building. The subject cooperated and was taken into custody without incident. At the time, the subject was arrested on the active warrant. He was later transported to the Palm Beach County Jail while investigators continued to conduct interviews and gather evidence to determine the subject’s involvement in the death investigation.

Surveillance video was obtained from various locations along Federal Highway linking the person of the interest to the homicide. Search warrants were obtained for the person of interest’s office and vehicle, and Probable Cause was established to charge him with Premeditated First-Degree Murder with a Firearm.
