BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2023 MetroDesk Media, LLC) — A Boca Raton woman was viciously mauled by a violent, large dog, and the shopping center that was supposed to enforce its own dog rules didn’t — at least according to a suit just filed in Palm Beach County Circuit Court.

The complaint, obtained by BocaNewsNow.com, reveals that Maureen Kaszubski was “throwing out the trash in the dumpster near her place of employment when she as the dog owned by Defendant, Anita Carlson, and asked the Defendant to please keep her dog restrained since she is afraid of large dogs. Plaintiff Maureen Kaszubksi was then viciously attacked near the dumpster area of the subject property by Ania Carlson’s large dog, which resulted in bodily injuries, pain and suffering, disability, disfigurement, mental anguish, loss of capacity for the enjoyment of life, medical expenses,” and more.

According to the suit, Boca Hamptons Plaza LLC, which manages the property on Kimberly Blvd. at Lyons Road, “had a duty to maintain the safety of licensees, invitees, and/or employees who work at the Subject Property such as the plaintiff, and ensure that those individuals are safeguarded from attacks by vicious dogs.”

The suit alleges that Boca Hamptons Plaza Management knew the dog was on the property and violent. Even so, management allegedly did nothing about the apparent dog problem.

“As the owner of the shopping plaza, the Defendant, Boca Hamptons Plaza LLC had actual and or sufficient knowledge of the dog’s presence on the subject property, either personally or through its agent(s) on the Subject Property grounds, especially since Defendant Ania Carlson leased one of the units in the Subject Property and maintained a business at the Subject Property.”

The suit seeks in excess of $50,000, the statutory minimum for filing in Palm Beach County Circuit Court. The alleged victim is represented by attorney Carla Martinez of Coconut Grove. Boca Hamptons Plaza had not filed a response that had been processed by the Clerk of Courts as of 5:45 a.m. Thursday.
