BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2023 MetroDesk Media, LLC) — In what may be an extraordinary violation of the Florida Homeowner’s Association Act, BocaNewsNow.com has learned that two members of the Board of Directors for an HOA in a large community in South Palm Beach County served termination papers on the management team of its in-house restaurant.

If true, this would be the fourth time in just a handful of years that the restaurant in the community has been axed. It would also represent a potential violation of Florida Statute 720.303, which requires a Board of Directors to make major decisions — like the operator of a restaurant — during open meetings. Sources say no public discussion occurred about terminating the current operator. Sources say the directors who allegedly terminated the current operator are discussing the reinstatement of a previous operator that is currently suing the community for slander and libel.

BocaNewsNow.com reached out to the two members of the community’s board of directors for comment but received no response. The community’s management company did not immediately respond to a request from a homeowner to provide a copy of the termination letter. An HOA does have 10 days to comply with a homeowner document request under Florida Statute.

Those familiar with the situation believe the termination will all but guarantee the community’s restaurant will go dark, as employees will be disinterested in remaining in a business that is expected to close within months. The sources said it was unclear what would happen to an estimated hundreds of thousands of dollars prepaid by homeowners as part of a “mandatory” spend.
