Cops Say Case Of Beer Open In Car Crashed By Unlicensed Driver.

DELRAY BEACH, FL (BocaNewsNow.com) (Copyright © 2023 MetroDesk Media, LLC) — A teenager who allegedly caused a crash in Delray Beach is now facing a DUI charge after police say they found an open case of “Modelo” beer in his car. Cops say the teen had a “strong odor” of alcohol when they approached his vehicle, and that he admitted to drinking multiple beers over a short period of time before the crash at Congress and Linton Blvd. on Tuesday. BocaNewsNow.com just obtained the police report which states the following about Andres Sebastien, 19, of Ilene Court in Delray Beach.

I responded to the intersection of W Linton Blvd and S Congress Ave to assist with a motor vehicle crash. Upon my arrival, I observed Andres Sebestian, a Hispanic subject with no shirt on, behind the wheel of a 2012 Honda Civic. When approaching the vehicle, I noticed an open case of Modelo beers, with several opened cans in the vehicle. When speaking to Sebestian, I smelled a strong odor of an alcoholic beverage. I also observed Sebestian had very glossy eyes and slurred speech. I asked Sebestian to step out of the vehicle. When stepping out of the vehicle he became very unstable and needed assistance to the parking lot on the NW corner of the intersection. When escorting him to the parking lot, he felt extremely warm to the touch.

Ofc. Hernandez assisted with translation during the DUI investigation. While Ofc. Hernandez asked him questions, I noticed Sebestian swaying back and forth. Ofc. Hernandez asked him for his license, and he stated he did not have one. Sebestian identified himself and provided a birth date of 01/09/2005, which contradicts the age he provided (19yoa). Ofc. Hernandez then asked how many beers he drank, and he stated, “6 or 7 beers between noon and the time of the crash”.

Sebestian was placed under arrest and transported to the Palm Beach County Breath Alcohol Testing Facility. While enroute Sebestian became very emotional and started crying in the backseat of the patrol vehicle. His mood fluctuated from crying to insulting behavior and this continued throughout his time at the BAT.

We arrived at the BAT facility at 6:57 pm and conducted a 20-minute observation. Sebestian was asked to provide a breath sample pursuant to Florida State Statutes for the purpose of determining its alcohol content. Sebestian refused and was read the Implied Consent Warning. He stated he understood and refused a second time.

Andres Sebatian was booked into the Palm Beach County Jail and charged with both DUI and operating a vehicle without a license. He was later released on his own recognizance pending a court date.
