PALM BEACH COUNTY, FL (BocaNewsNow.com) (Copyright © 2023 MetroDesk Media, LLC) — A South Florida man is suing Rapid Waters Park for libel and slander, after park employees allegedly made a salacious claim that landed the man in criminal legal trouble. That trouble went away, but now he is seeking revenge.
Juan Rosa, according to a complaint obtained by BocaNewsNow.com, was enjoying the Rapids Water Park with his family on June 27, 2022, when his wife tripped on her flip-flop. That flip-flop broke and she fell to the ground, apparently getting up moments later — unscathed.
But Rapids Water Park employees allegedly claimed that they watched Juan push his wife to the ground, something he says never happened. The workers pointed to video evidence, but when law enforcement and prosecutors sought that video, it suddenly didn’t exist. As is often the case, an accusation of domestic battery is enough to lead to an arrest. Juan Rosa was arrested and booked into the Palm Beach County Jail. The State Attorney’s Office ultimately decided NOT to prosecute the case.
Now, Rosa is suing Rapids Water Park, claiming that park employees defamed him, branded him as a “wife-beater,” and caused irreparable harm by landing him in jail. Here are some of the claims from the suit:
“Plaintiff was forced to retain legal counsel for a crime that never occurred, was detained by RAPIDS against his will, has an arrest record based upon false allegations made to the police.
Plaintiff has otherwise suffered damages due to the Defendant’s failure to properly train and educate its employees.
Defendant’s agent’s attempt to destroy the reputation of the Plaintiff through a character assassination designed to depict Plaintiff as a “wife-beater” is intentionally false statements the utterance of which has damaged Plaintiff.
Defendant possessed no mechanism to independently verify any of the outlandish claims asserted against Plaintiff yet management and other of Plaintiff’s agents stood by during the fabricated incident and support the reporting agent’s false and defamatory statements to police.”
The suit seeks in excess of $50,000 — the statutory minimum for filing in Palm Beach County Circuit Court. Rapids Water Park had not filed a response processed by the Palm Beach County Clerk of Courts by 5 a.m. Wednesday, December 13, 2023.
