DELRAY BEACH, FL (BocaNewsNow.com) (Copyright © 2023 MetroDesk Media, LLC) — Manor Care of Delray Beach is facing a major lawsuit after a resident of the nursing and rehabilitation center on Jog Road near Linton allegedly was so poorly cared for, that he was told to hold onto a walker that actually collapsed while he was using it for balance.
The suit, just filed in Palm Beach County Circuit Court and obtained by BocaNewsNow.com claims that Ivan Carr was in Manor Care for rehabilitation when the following occurred on March 29, 2022.
“On or about March 29, 2022, one or more of Defendants’ nurses, therapists, caretakers, or other employees, transported Plaintiff via wheelchair from his room at subject nursing home to the physical therapy suite at the subject nursing home for a previously scheduled physical therapy session. Defendants’ nurses, therapists, caretakers, or other employees instructed Plaintiff to get out of his wheelchair and use a walker that was assembled, inspected, maintained, repaired, and provided by the subject nursing home.
Plaintiff took one step with the walker when suddenly and without warning the back legs of the walker slid down, and the walker collapsed, causing Plaintiff to fall. Plaintiff attempted to grab a chair beside him to break his fall. While falling Plaintiff’s left knee and elbow struck the chair. As a result of the fall, Plaintiff sustained injuries, including, but not limited to, a partial dislocation of the forearm and a partial dislocation of the knee.”

The suit claims bad management and untrained workers at Manor Care Delray Beach led to the improperly assembled walker being given to a patient who needed a walker for stability. The suit seeks in excess of $50,000 — the statutory minimum for filing a complaint in Palm Beach County Circuit Court. Ivan Carr is represented by the law firm of Wites and Roger’s, P.A., in Lighthouse Point.
Manor Care, currently the subject of at least 17 lawsuits filed in Palm Beach County against its Palm Beach County locations, did not immediately file a response processed by the clerk of courts. Read the lawsuit in its entirety below.
As a Retired NY State licensed Nursing Home Administrator I find this very troubling. My Mother in law of blessed memory was in one of the Manor
Cares many years ago… she signed
Herself out because of inadequate care!
She was also in another facility and her aide was horrid. I reported the aide as she
Was rude to mom in front of me and moms
Private Aide! FLORIDA DEPARTMENT OF HEALTH NEEDS TO BE MORE PROACTIVE
WITH STRICTER STANDARDS FOR THESE FACILITIES. IT IS DISGRACEFUL.
I don’t know if there is a time limit but my dad was there. He was a fall risk and they had no one there to check on him . He got into a wheelchair himself and he fell backwards in the wheelchair. He hit his head and laid there for 2 hours before they even found him lying there . He was banging on the wall to get someone’s attention… finally they rushed him to the hospital. This place should be shut down !!! My father has since passed away, but I still want to Sue them for this . His door specifically said “fall risk “!
And they were rude and the nurses/staff rolled their eyes when I would ask them to do something or help him into the bathroom.
My mother was in Manor Care several years ago. She was bedridden and unable to use the bathroom. The staff did not change her and left her to lay in a urine drenched pull-up nor did they not once turn her in bed to prevent bed sores. I complained to the head nurse and nothing changed. I immediately requested that she be moved to another facility. I was told that if I moved her form Manor Care this stay would all be out of pocket, insurance would not cover any of the costs. I did move her out!!! What goes on there is dehumanizing, cruel. and abusive. My mother was lucky to have an advocate. Just think of all of those poor souls that have no one to advocate for them.
