BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2023 MetroDesk Media, LLC) — Popular discount prescription drug program “GoodRX” may face a class action lawsuit in Palm Beach County after a woman claims she received an email from the company seeking payment after 9 p.m.
Attorneys for Virginia Avedisian say their client received an email regarding a past due balance for a “gold” membership at 5:41 a.m., which falls between the “do not contact hours” of 9 p.m. and 8 a.m. set by the Florida Consumer Collection Practices Act, known as the FCCPA. Whether an email, which requires no interaction and can be ignored, truly falls into the FCCPA’s “do not contact” rules is up for argument.
Also up for debate: whether the email to Avedisian was truly a “debt collection” attempt or merely a notification of a potential technical issue. The email from Good RX says “we had trouble authorizing payment” of the monthly Gold Membership fee. It does not suggest that action is pending against Avedisian, and also does not suggest that credit bureaus would be notified if payment was not made immediately.
The suit ponders whether GoodRX routinely sends messages like these, or perhaps more strongly worded collection notifications to Florida residents between the hours of 9 p.m. and 8 a.m. It seeks a minimum of $50,000 which is the statutory minimum for filing in circuit court in Palm Beach County. We note a Gold membership costs $9.99 per month.
