BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2024 MetroDesk Media, LLC) — A stunning lawsuit filed against “The Boca Raton,” once known as the Boca Resort, alleges gross incompetence by a staff that draped tablecloths with such length that a diner got trapped — falling to the ground and sustaining critical injuries.

The lawsuit, just filed in Palm Beach County Circuit Court, alleges that Phyllis Riesner was a guest of the hotel for Easter Brunch on April 9th, 2023.

“The Easter Brunch at the subject premises was buffet style, requiring invitees to leave their table to obtain a meal. Phyllis Riesner stood as she planned to start her meal and sought to obtain food. As Plaintiff stood, she turned toward the buffet, her foot, unbeknownst to her, became entangled in the excessively draped tablecloth, causing her to immediately lose her balance and fall onto her left side. Following her fall, Plaintiff’s family members observed the excessive length of the tablecloths appeared to have been tucked, unsecured under the table, rendering the danger of entanglement hidden at (The Boca Raton).”

Ms. Riesner, according to the suit, was rushed by ambulance to Boca Raton Regional Hospital and admitted with multiple injuries — including fractures — which required surgery. The suit seeks in excess of $50,000, the statutory minimum for filing in Palm Beach County Circuit Court.

The Boca Raton has not filed a response to the suit with the Palm Beach County Clerk of Courts as Friday, February 2nd, 2024. Ms. Riesner is represented by Attorney Andrew Norden of Osborne and Francis, PLLC, of Boca Raton. Read the complete complaint below.
