POLICE: Slumped Over Steering Wheel With Open Bottle Of Vodka.

BOCA RATON, FL (BocaNewsNow.com) (Copyright © 2024 MetroDesk Media, LLC) — A Boca Raton woman is facing a DUI charge after police say she was found slumped over the steering wheel of the Tesla Model 3. She was allegedly found with an open bottle of Vodka next to her in the parking lot of a Wawa in Boynton Beach.
The Boynton Beach Police Department filed this report about the arrest of Elisa Casanova of the 8300 block of Via Leonessa in Boca Raton.
“On 02/21/2024, at approximately 0138 hours, I was patrolling the Wawa parking lot, 2505 W Woolbright Road, Boynton Beach FL 33436 when I observed a white female, slumped over in the driver seat of a 2023 black Tesla Model 3 bearing. Based on the above, I approached the vehicle and made contact with the driver/sole occupant, W/F Casanova, Elisa, 53, to ensure that she did not need medical attention; which she refused.
In plain view, I observed Casanova in possession of an open container, (Absolut Vodka 50ml). When I made contact with Casanova, her eyes were glossy and her speech was slurred. She advised that she was just tired and consumed alcohol much earlier in the day. When I requested for Casanova’s driver’s license, registration, and proof of insurance she was easily distracted then advised that her license was in the trunk.

I then requested for Casanova to retrieve the documents. When Casanova exited her vehicle, she was unsteady on her feet and held onto the vehicle for balance. While speaking with Casanova outside of the vehicle, she continued to show signs of impairment. Her pupils were dilated and her speech was thick. She had difficulty focusing and swayed back and forth. At this point of my investigation, I had asked Casanova if she would be willing to submit to a Series of Standardized Field Sobriety Task, which she agreed to. Prior to beginning I asked Casanova if she had any disabilities and/or injuries; which she stated no.”
Casanova allegedly had problems completing the field sobriety tests, then provided urine instead of submitting to a breath alcohol test. While her alleged blood alcohol content has not be logged, she was arrested and charged with driving under the influence. She was booked into the Palm Beach County Jail where bond was initially set at $1,000. She was later released. A court date is pending.
I’m confused here. She was in the parking lot of WAWA. in a parked vehicle, not in motion. How can she be charged with DWI or DUI?
If you are in the drivers seat of a vehicle and appear drunk, you can be charged with DUI in pretty much every state.
She probably tried to gas up her Tesla and was intoxicated by the gasoline fumes….
