DELRAY BEACH, FL (BocaNewsNow.com) (Copyright © 2024 MetroDesk Media, LLC) — A Delray Beach resident is suing Tesla, claiming that the electric vehicle maker lied about the range of its Model S vehicle. The vehicle, according to Plaintiff Jesse Davidson, is supposed to have a fully charged range of 402 miles. But he claims in a lawsuit obtained by BocaNewsNow.com that the actual range is 350 miles.

While Electric Vehicle owners know that that range is based on previous use habits — drive more on a highway, your range is lower; drive more on side streets and your range is higher — he’s claiming that Tesla is negligent for its advertising and marketing of the vehicle.

From the complaint: “At the time of the purchase of the 2022 Tesla Model S Long Range and prior to the purchase, TESLA knowingly misrepresented that the vehicle charges up to approximately 402 miles which is a false, material fact. Tesla knew the misrepresentation was was false. TESLA represented the battery to be ‘long range’ and charge up to 402 miles with the intention of Plaintiff relying on such representation.”

Davidson is an attorney and representing himself. He seeks a jury trial and damages of more than $50,000. It was not immediately clear why Davidson did not pursue Lemon Law action in Florida, traditionally required if a vehicle owner is making a claim regarding a vehicle’s functionality. Tesla did not immediately file a response to the suit.
